Following receiving a refusal for permission to Appeal Mrs Justice Stacey’s order we have now proceeded with our application to the European Court of Human Rights.
5G Radiation and Risks and Danger posed
The European Parliament’s Panel for the Future of Science and Technology has noted that there is evidence of the carcinogenic potential of lower frequencies RFR and that there are “no appropriate studies” that assess the impact of the higher frequency range of 5G.
The panel called 5G “an experiment on the population.”
The UK government asserts that it is rolling out 5G safely by keeping radio wave emission levels within ICNIRP’s Guidelines for limiting exposure to electromagnetic fields, which it primarily relies on to demonstrate 5G’s safety. However, neither ICNIRP nor the government have carried out any investigation into the risks of adverse health effects from 5G.
Similarly, there have been no significant international investigations into the risks of 5G to conclusively determine the safety of 5G through a health risk assessment of exposure to radio frequencies including 5G.
The health problems that exposure to RFR can cause are well documented and evidenced. ICNIRP itself states that radio frequency EMF’s have been found to cause nerve stimulation, changes in the permeability of cell membranes, and effects due to temperature elevation.
The evidenced risks of RFR and the risks that remain under consideration and are presently unknown mean that the rollout of 5G poses risk to the public and particular danger to vulnerable groups which have not been adequately considered.
ICNIRP acknowledges that RFR can interfere with individuals’ implants, but states that is beyond the scope of its Guidelines. Further the Guidelines expressly state that while they “are based on the best science currently available, they recognise that there may be limitations to this knowledge that could have implications for the exposure restrictions”.
The Guidelines go on to note that “There is not sufficient research addressing potential relations between radio frequency EMF’s and the skeletal, muscular, respiratory, digestive, and excretory systems, and so these are not considered further”.
The government has not taken any measures to warn people of the risks of 5G and instead has misrepresented to the public that the technology is already known to be safe.
On 3 October 2019, it published a guidance document, ‘5G technologies: radio waves and health’, which concluded that: “However, the overall exposure is expected to remain low relative to guidelines and, as such, there should be no consequences for public health”. This is not a true and accurate reflection of the state of scientific and medical knowledge.
This case is concerned with the safety of the environment in which people live, and the state’s duty to provide information in relation to man-made industrial risk to the public. There has been a failure to identify that the risk is
(a) a known risk which has been already established to exist from past inquiry (known, already proven harm), AND that
(b) the duty encompasses a risk of future harm that is presently not conclusively established or quantified, but cannot be presently discounted and so remains an unquantifiable identified risk.
